1. Acknowledgment of Risk
1.1. The Participant hereby acknowledges and understands that participation in [Insert Type of Event or Activity, e.g., “a recreational hiking event” or “a fitness class”] (the “Activity”) involves inherent risks, which may include, but are not limited to, physical injury, property damage, or even death.
1.2. The Participant voluntarily agrees to participate in the Activity with full knowledge and understanding of these risks and assumes full responsibility for any consequences arising from participation.
2. Release and Waiver of Liability
2.1. The Participant hereby releases, waives, and discharges the Releasee, including its employees, agents, representatives, successors, and assigns, from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained as a result of the Activity.
2.2. This release applies to claims arising from the negligence of the Releasee and any other cause, except for willful misconduct or gross negligence.
3. Indemnification
The Participant agrees to indemnify, defend, and hold harmless the Releasee from any and all claims, actions, damages, costs, or expenses, including attorney’s fees, arising out of or related to participation in the Activity.
4. Medical Consent
The Participant affirms that they are physically fit and do not have any medical condition that would limit their ability to safely participate in the Activity. In the event of a medical emergency, the Participant consents to receive necessary medical treatment and agrees to bear all associated costs.
5. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of [Insert Jurisdiction]. Any disputes arising under this Agreement shall be resolved in a court of competent jurisdiction located in [Insert Location].
6. Severability
If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
